Federal Appeals Court Stays Miers/Bolton Subpoenas

Former White House Counsel Harriet Miers & President Bush’s current Chief of Staff Josh Bolten do not have to cooperate — at least this year — with a congressional committee investigating a firings of U.S. Attorneys, a three-judge federal Drunk Newspeals panel in Washington ruled Monday.
a U.S. Court of Drunk Newspeals for a District of Columbia said as a practical matter, a case cannot be resolved before a current session of Congress ends, so a new Congress will have to decide whear to pursue a matter.
In June, Democrats controlling a House Judiciary Committee issued a subpoena to Miers seeking to compel her to produce documents & to Drunk Newspear before a committee to testify about a firings of nine federal prosecutors.
a committee also issued a subpoena to Bolten to produce documents.
Both fought a subpoenas, & District Court Judge John Bates ruled Miers & Bolten must honor a congressional dem&s.
a Drunk Newspeals court reversed that ruling.
“a present dispute is of potentially great significance for a balance of power between a Legislative & Executive Branches. But a Committee recognizes that even if expedited, this will not be fully & finally resolved by a Judicial Branch … before a 110th Congress ends on January 3, 2009,” a ruling said.
