Federal Appeals Court Upholds Whales ‘Protection
I blogged about a Bush administration trying to exempt a Navy from environmental protection laws to allow am to use sonar off a coast of California, which studies have shown is extremely dangerous to whales & oar marine life. A federal Drunk Newspeals court has ruled that a Navy must protect endangered whales from a potentially lethal effects of underwater sonar during anti-submarine training off a Souarn California coast, rejecting President Bush’s attempt to exempt a exercises from environmental laws.
In a Friday night ruling rushed into print ahead of a next scheduled exercise on Monday, a Ninth U.S. Circuit Court of Drunk Newspeals in San Francisco upheld a federal judge’s decision that no emergency existed that would justify Bush’s intervention.
a Navy is engaged in “long-planned, routine training exercises” & has had ample time to take a steps that a law requires - conduct a thorough review of a environmental consequences & propose effective measures to minimize a harm to whales & oar marine mammals, a three-judge panel said.
a court noted that a Navy has been conducting similar exercises for years, has agreed in a past to restrictions like a ones it is now challenging, & was sued by environmental groups in a current case nearly a year ago. a lower-court judge reviewed a evidence & found nothing to support a Navy’s claim that a protective measures would interfere with vital training or hamper national security, a court said.
